Representative Matters:

Forsberg & Umlauf represented a manufacturer of a thermal recovery unit placed in industrial smokestacks. The facility owner alleged that the recovery units were defective and cost the owner millions of dollars in lost energy costs. Our attorneys prevailed on summary judgment by arguing that there were no defects and that the UCC Warranties on such products did not apply to the alleged loss.

Forsberg & Umlauf represented a credit union in a suit alleging fraud by a credit union member. The credit union prevailed in a bankruptcy adversary proceeding when the court found that the alleged fraudulent activity was not discharged in bankruptcy.

Forsberg and Umlauf successfully represented a major credit card company in a case by a consumer alleging the company violated federal laws regulating credit practices. After the case was dismissed in United States District Court, the plaintiff appealed to the 9th Circuit.  Our attorneys were also successful at the appellate level as the 9th Circuit upheld the original dismissal.
